The Arbitration Court of St. Petersburg and Leningrad region declared illegal and quashed the FAS Russia of 07.09.2009 on the imposition of a fine of $ 19 642 891 rubles on the case of administrative violation against CJSC BaselCement-Pikalevo, the company reported.
This fine was imposed in connection with the fact that earlier, FAS Russia recognized that the JSC “BaselCement-Pikalevo” violated the law on protection of competition. The company considered illegal imposition of the order and challenged it in court.
According to FAS, the antimonopoly violations manifested in the cessation of shipments in 2008, nepheline sludge (raw material for cement production) at JSC “Pikalevo cement and reducing the supply of carbonate solution (raw material for soda and potash) at the JSC” Metakhim ” the presence of existing supply contracts. FAS ordered the owner to either sell the plant in Pikalevo, or to resume the supply of raw materials to subcontractors the same price.
